In his opening speech, Vice Minister of Commerce Fang Aiqing pointed out that the Third Plenary Session of the 18th CPC Central Committee made important arrangements for comprehensively deepening reforms. Building a unified, open, competitive and orderly market system, and allowing the market to play a decisive role in resource allocation will be the focus of reform in the future. China's antitrust agencies need to implement competition policies in depth and carry out antitrust law enforcement more effectively, so as to serve the overall situation of reform and opening up and meet the new challenges of global competition.

Zhang Qiong, leader of the expert advisory group of the State Council Anti-Monopoly Commission, emphasized that giving full play to the function of competition policy in the operation of the market economy is an important basis for the market to truly play a decisive role in resource allocation, and is also an important basis for promoting the sustainable and healthy development of the market. The expert advisory group will conduct in-depth research on the relationship between competition policy and industrial policy, and will be deeply involved in the study of major anti-monopoly matters and the handling of major cases.

The forum focused on three major issues: the value of competition policy in deepening market economic reform, its role in breaking regional blockades, and the relationship between intellectual property protection and antitrust law enforcement. The heads of the three domestic law enforcement agencies jointly believe that competition policy should become the country’s basic economic policy and play a greater role; abuse of administrative power should be cracked down on in accordance with the Anti-Monopoly Law and regional blockades should be broken; the protection of intellectual property rights should be given priority, but careful and professional competition analysis of suspected abuse of intellectual property rights to restrict competition is also required.

The heads of foreign competition authorities also responded positively to these issues based on the characteristics and experiences of their respective countries and institutions. During the three-hour roundtable forum, the guests also exchanged views on issues such as coordination between competition agencies and industry regulators, administrative monopoly, antitrust litigation, antitrust and consumer protection, and disclosed the latest developments in well-known cases such as the Tetra Pak case.

Professor Huang Yong pointed out in the summary, the goal that the market plays a decisive role in resource allocation proposed by the Third Plenary Session of the Central Committee of the Communist Party of China is not empty. It is reflected in the competition policy at the policy level and the Anti-Monopoly Law at the operational level. For my country's transitional economic system, the Anti-Monopoly Law has a special function in breaking regional blockades and administrative monopolies and establishing a competitive and orderly market. The investigation and handling of administrative monopoly cases by law enforcement agencies can effectively promote the establishment of a more unified, competitive, open and orderly market.

According to reports, the next two days of the meeting will also discuss cutting-edge issues in the implementation of antitrust laws such as "recent developments in price-related antitrust practices", "abuse of market dominance and the intersection of antitrust laws and intellectual property rights", "comprehensive examination of merger and acquisition review from declaration negotiation to relief measures", "antitrust private litigation".

As one of the brand activities of the Expert Advisory Group, this China Competition Policy Forum is the highest-level conference held in my country in the six years since the implementation of China’s Antitrust Law. It is also the first academic conference held in China by the Antitrust Law Branch of the American Bar Association.
