[Exchange] Competition Law Center successfully held a high-level seminar on "Promoting Innovation and Competition"

As the highest-level interdisciplinary academic seminar in the field of domestic antitrust law, this conference specially invited the U.S. Federal w88 Commission (FTC)Commissioner William KovacikWilliam E. KovacicMr. and the Director of the International Division of the Federal w88 CommissionRandolph Trettle (Randolph Tritell)Mr.Come to Beijing to attend the meeting, and Commissioner William Kovacik will give a keynote speech.

Principal Shi Jianjun delivered a speech. President Shi first welcomed all experts and scholars participating in the seminar on behalf of the w88 casino. Then, he talked about his views on the theme of this seminar, "Innovation and Competition." Principal Shi said,There is a complex interactive relationship between technological innovation and corporate competitiveness,such asHow to deal with the relationship between technological innovation and competition is a very distressing and troubled issue in China's current economic development. This problem reflects the value conflict between freedom and equality, the binary opposition between subject and object, and condenses contemporary society's profound questioning of individualism, freedom, fairness, and rationalism. The solution to this problem requires superb system design and law enforcement art. President Shi also vividly compared the differences and reasons for the level of intellectual property protection between China and the West through two distinct examples.

Commissioner William Kovacik delivered a keynote speech entitled "Competition Policy, Intellectual Property and Innovation". Mr. Kovacik just stepped down as Chairman of the U.S. Federal w88 Commission in March this year, but he still serves as a committee member. In addition to his many years of teaching and legal practice experience, he is very familiar with the basic theory and operational practice in this field. His speech was profound and full of wisdom. His words were humorous and his tone was ups and downs. The participants were deeply inspired and benefited a lot. In a short period of time, they were able to understand the actual practice of the U.S. antitrust law enforcement agenciesBasic concepts and policies when dealing with the relationship between innovation and competition in international work.

This seminar also invited the Dean of the w88 casino of Intellectual Property of Renmin University of ChinaLiu ChuntianProfessor Kong Xiangjun, President of the Intellectual Property Tribunal of the Supreme People's Court, Chen Fuli, Intellectual Property Commissioner of the Chinese Embassy in the United States, and Zhao Guobin, Director of the Competition Enforcement Bureau of the State Administration for Industry and Commerce, gave keynote speeches. After the keynote speech, the participants also had extensive exchanges on related issues. Everyone spoke freely and had a heated discussion on issues related to antitrust law and intellectual property protection.

Finally,Huang YongThe professor made a concluding speech. He pointed out that in theory, the goals of the intellectual property system and antitrust law should be consistent, which are to stimulate innovation, promote competition, and ultimately benefit consumers. But the prerequisites for achieving this theoretical goal are: first, the principle of scientifically applying the principles of antitrust law to judge intellectual property abuse should be established, that is, a scientific judgment rule should be formulated for what constitutes intellectual property abuse;Second, we must establish an ideal and well-functioning intellectual property system and formulate appropriate threshold standards for intellectual property protection, which cannot be too low; third, we must maintain a moderate tension between anti-monopoly law and intellectual property protection, and balance the relationship between the two; finally, we must also look at the characteristics of our country's current development stage. At this stage, we are not an innovative country, but are in the primary stage, and we should have phased considerations for our country.

More than 100 people from home and abroad, including relevant experts and scholars, government officials, well-known multinational companies, famous Chinese and foreign law firms, and representatives from the publishing industry attended the seminar. Among them, not only LaiOfficials from the National People’s Congress Legal Affairs Committee, the State Council’s Legislative Affairs Office, and the three major antitrust law enforcement departments—the National Development and Reform Commission, the Ministry of Commerce, and the State Administration for Industry and Commerce,As well as relevant leaders from the Ministry of Science and Technology, the Ministry of Industry and Information Technology, and the State Intellectual Property Administration; and the Supreme People's Court is responsible for hearing antitrust casessenior judges; there are also well-known experts and scholars in law and economics from Peking University, Tsinghua University, Chinese Academy of Social Sciences, Renmin University of China, China University of Political Science and Law, Central University of Finance and Economics, Tianjin University of Finance and Economics, and East China University of Political Science and Law, as well as directors from Law Press, Peking University Press, "Intellectual Property", "Electronic Intellectual Property", and "China Intellectual Property" magazines; In addition, the seminar also specially invited the Intellectual Property Commissioner of the Chinese Embassy in the United States, the European Union Counselor in China, etc. to participate.
