This lecture focuses on hot topics and aims to provide an incisive analysis and explanation of the different regulatory models for digital w88 governance in the three major economies of China, the United States and the European Union. The keynote speaker, Professor Gao Shuchao, gave an in-depth explanation of the different models of digital w88 regulation. Professor Zuo Haicong, Professor Shi Jingxia, experts Hong Xiaodong and Professor Hong Yanqing further elaborated on relevant key and difficult issues, and had a lively discussion on the compatibility of China, the United States and Europe's regulatory models and the future direction of multilateral rules. The speaker, Professor Gao Shuchao, first compared the positions of China and the United States on the regulation of digital w88 issues, explaining that the basic difference between them is that China still treats digital w88 as a basic w88 issue, while the United States regulates it as a specialized digital w88. Professor Gao Shuchao believes that currentlyThe WTO has not yet reached a corresponding negotiation agreement on e-commerce issues, so the task of regulating digital w88 falls into the hands of sovereign states. As three "digital kingdoms", China, the United States and the European Union have different core demands for data protection, which leads to differences in their models of digital w88 regulation. First of all, the core demand of the United States for digital w88 is to require data to flow freely across borders around the world, while prohibiting the localization of data. In terms of the protection of personal information, the United States lags behind in protecting consumer data privacy. It believes that without consumption, there is no right to personal information protection. On the contrary, the EU's core demand is to protect personal privacy, which is mainly reflected in the fact that GDPR treats information protection as a basic human right, not a consumer right. China’s pursuit of digital w88 is national security. It believes that without data security, there is no national sovereignty. Data security and national sovereignty are interrelated. To this end, China has established an Internet censorship system to restrict cross-border data flows to maintain national information security. In addition, after the promulgation of the Personal Information Protection Law, it has become more difficult for personal information to be exported abroad, and the level of information protection based on national security has increased.

Professor Gao Shuchao also pointed out that the reason why the three parties’ digital w88 regulations have different focuses lies in their differences in commercial interests. American data providers, the most typical ones are Google,Facebook is a completely digital enterprise, providing virtual pure digital services and online search business. Typical representatives of China, such as Alibaba and JD.com, are essentially traditional goods trading systems. Due to the different positions of the two parties, there are differences in their core demands. The EU's surface information protection is actually digital protectionism, which aims to raise digital protection standards and make it more difficult for companies from other countries to enter the EU market, so as to support the development of companies within the EU. In addition, Professor Gao Shuchao explained the reasons why the EU has elevated the protection of personal information privacy to the level of human rights, and predicted the future development of the three major "digital kingdom" legal regulation models, that is, the three models will learn from each other and integrate with each other in the future. China's digital legal regulations will gradually become more refined and develop continuously for the better.

Professor Zuo Haicong fully affirmed Professor Gao Shuchao’s views and believed that in terms of the future development trends of the three major models, the models of the United States and China may converge, but the convergence of the EU may be more difficult because the EU uses human rights as the basis for data protection. At the same time, three major models can be used as a framework for analyzing different legal regulations.

During the discussion session, Professor Shi Jingxia agreed with Professor Gao Shuchao’s summary of the rules and characteristics of digital w88 between China, the United States and Europe, and usedThe words “pro-w88”, “pro-privacy” and “pro-security” respectively refine the propositions of the United States, the European Union and China on digital w88 regulations. Professor Shi Jingxia believes that although the three models in China, the United States and Europe each have their own emphasis, none of the three models prohibits the cross-border flow of data at the rule level. However, specific practices or implementation measures reflect the differences between the three models. Whether the three models can converge and integrate at the rule level in the future, especially what results can be achieved in e-commerce negotiations under the WTO framework, deserves close tracking and study. Professor Shi added that in addition to data-related issues, the obligation of non-discriminatory treatment of digital products is also an issue worthy of special attention in China, especially during the application or negotiation process to join CPTPP and DEPA.

Hong Xiaodong, an expert from the China World w88 Organization Research Association, analyzed how the existing framework handles the relationship between promoting commercial interests, protecting personal privacy and national management rights from the perspective of international digital w88 rules. By analysisRegarding the provisions on cross-border transmission of electronic information in CPTPP, RCEP and DEPA, Hong Xiaodong pointed out that the existing rules recognize the rights of each member to supervise data and allow cross-border transfer of data after supervision, but at the same time set up an exception for legitimate public policy goals as a response to the protection of personal privacy or other interests. The rules well balance the relationship between commercial interests, personal privacy protection and national management rights. Professor Hong Yanqing discussed domestic and international digital w88 rules using digital w88 rules in domestic law as an entry point. Professor Hong Yanqing first raised the theoretical issue of how to view the relationship between international rules and domestic rules. Afterwards, Professor Hong Yanqing took China's data export assessment system as an example to explain the relevant international rules and the rules and practices of other countries that will be considered when understanding the domestic laws and regulations of digital w88. In the free discussion session, Professor Liao Shiping raised questions and elaborated on his views on the impact of the business separation of the negotiation department and the regulatory department and the rationality of their settings, as well as the struggle and cooperation in law formulation and negotiation. Professor Hong Yanqing responded to this. Professor Hong believes that each department has different responsibilities, so it adopts a division of labor supervision approach, which is reasonable. In the formulation and negotiation of laws, countries adopt an interactive perspective on technical data security issues. This interactive process cannot be reflected in certification and evaluation. It is an institutional and social issue. Therefore, there is struggle and cooperation in the negotiation of digital w88 rules.

In the summary of the lecture, Professor Zuo Haicong believed that the discussion of digital w88 rules from a theoretical and practical perspective is continuously deepening, and the domestic regulatory legislation and practice in China, the United States and Europe, as well as regional and multilateral rules are also constantly developing. In terms of achieving the goal of digital free w88, it is still difficult to reach convergent global rules due to the different national conditions and interests of various countries, but it is even less difficult to achieve coordination and form rules in regional w88 agreements. Practical and academic circles need to strengthen in-depth research on the interactive relationship between domestic regulation, regional and multilateral rules in China, the United States and Europe.
