Professor Zhang Wenxian is a senior professor of philosophy and social sciences (first-level professor) at Jilin University. He concurrently serves as a member of the Central Marxist Theory Research and Construction Project Advisory Committee, convener of the National Social Science Fund Legal Planning Review Group, member of the National Textbook Committee, member of the Social Science Committee of the Ministry of Education, convener of the Faculty of Law, and president of the Legal Education Research Association of the China Law Society. The theme of Professor Zhang Wenxian’s lecture is"Legal Interpretation of Chinese-style Modernization of the Rule of Law". Professor Zhang Wenxian’s interpretation mainly focuses on three aspects: first, the theoretical origin and practical basis of the concept of “Chinese-style rule of law modernization”; second, Chinese-style rule of law modernization is the organic unity of “common characteristics” and “Chinese characteristics”; third, China’s path to modernization of the rule of law.
Professor Zhang Wenxian first pointed out that Chinese-style modernization is the only way and strategic starting point for comprehensively building a modern socialist country and comprehensively promoting the great rejuvenation of the Chinese nation. The modernization of Chinese-style rule of law is a concrete manifestation of Chinese-style modernization in the field of rule of law. Professor Zhang Wenxian believes that,“Chinese-style modernization of the rule of law” has become a scientific proposition that runs through the entire rule of law system and legal system, and has become a topic of the times, a key area, and a hot issue in Chinese legal research.
Professor Zhang Wenxian emphasized that, first of all, Chinese-style modernization is comprehensive modernization, which must include the modernization of the rule of law; secondly, the modernization of the rule of law is the core element, important symbol and powerful guarantee of modernization; finally,“Chinese-style rule of law modernization” is a theoretical expression and academic representation of the practice of Chinese-style rule of law modernization.
Professor Zhang Wenxian believes that the modernization of Chinese-style rule of law isThe organic unity of “common characteristics” and “Chinese characteristics”. On the one hand, from a macro perspective, the Chinese-style rule of law modernization has the common characteristics of all countries in the world, such as the supremacy of the constitution, respecting and protecting human rights, supervising and restricting public rights, safeguarding fairness and justice, building social order, promoting human peace, and being based on the national conditions of each country. From a micro perspective, the modernization of the rule of law in various countries around the world has many identical or similar principles and methods of the rule of law. On the other hand, Chinese-style rule of law modernization also has distinctive Chinese characteristics: Chinese-style rule of law modernization is a modernization led by the Communist Party of China, a people-centered modernization, a modernization of comprehensively governing the country according to law, a modernization of the "rule of law in a great country", a modernization of continuing China's rule of law civilization, and a modernization of the era of globalization.
In terms of methodology, Professor Zhang Wenxian put forward six suggestions for creating a new path for the modernization of the Chinese-style rule of law. First, with the goal of building a modern socialist country with a strong rule of law, the goal is to expand a new path of Chinese-style rule of law modernization. Second, use the modernization of the national governance system and governance capabilities as a blueprint to expand the governance implications of the new path of Chinese-style rule of law modernization. Third, it is essential to take the common prosperity of all people as the top priority and expand the new path of Chinese-style rule of law modernization. Fourth, take the whole-process people's democracy as the cornerstone to expand the political civilization foundation of the new path of Chinese-style rule of law modernization.
