Article 1 These regulations are formulated in order to strengthen the management and supervision of leading cadres, promote the construction of a clean government and the construction of the ideological style of leading cadres.
Article 2 The term “leading cadres” as mentioned in these regulations includes: cadres at the deputy county (division) level and above (including deputy county (division) level, the same below) who hold leadership positions and non-leadership positions in party organs, people’s congress organs, administrative organs, CPPCC organs, judicial organs, and procuratorial organs at all levels. Cadres equivalent to deputy county (division) level or above in social groups and public institutions, middle-level leading cadres and above in large state-owned and extra-large enterprises, leading cadres in state-owned medium-sized enterprises, leading cadres appointed by state-owned equity representatives or appointed (including recruitment) by state-owned investment entities in large and medium-sized enterprises under the company system, elected leading cadres approved by the competent authorities, and leading cadres of the enterprise party organization.
Article 3 The reporter should report the following major matters:
(1) The circumstances in which the individual, his spouse, and children living together build, buy, sell, and rent private houses and participate in fund-raising for house construction;
(2) The handling of weddings and funerals for myself and close relatives that I participated in (excluding the above matters only handled within the scope of close relatives);
(3) The situation of intermarriage between myself and my children and foreigners and my spouse and children settling abroad;
(4) The circumstances in which I leave the country (territory) for personal reasons and conduct activities outside the country (territory);
(5) Situations in which spouses and children are investigated and punished by law enforcement and disciplinary agencies or suspected of committing crimes;
(6) The spouse or children are engaged in individual or private industry and commerce, or are contracting or leasing state-owned or collective industrial and commercial enterprises, are employed as corporate managers in foreign-funded enterprises, or are employed as managers in the domestic agencies of foreign enterprises in China, Hong Kong, Macao and Taiwan enterprises. Other major matters that I think should be reported to the organization can also be reported.
Article 4 The matters listed in Article 3 of these regulations shall be reported in writing by the reporter within one month after the incident. If the report cannot be made on time due to special reasons, a supplementary report should be made in a timely manner and the reasons should be explained. If prior approval is required according to relevant regulations, it shall be handled in accordance with the regulations. If I think I need to ask for instructions in advance, I can also ask for instructions in advance.
Article 5 Party committees and their disciplinary committees at all levels, the party groups of people’s congresses, governments, political consultative conferences, courts, and procuratorates at all levels, as well as the party groups (party committees) of departments and units (including public institutions, the same below) affiliated to the above-mentioned leading organs (including public institutions, the same below), are responsible for accepting reports from leading cadres at the same level (departments and units without party groups or party committees shall be accepted by the corresponding agencies, the same below). Reports from leading cadres of various departments and units’ internal organizations shall be accepted by the organizational and human resources departments of the departments and units. Reports on major personal matters of leading cadres of social groups, enterprises and institutions mentioned in Article 2 of these regulations shall be accepted by the party committee (party group) of the unit.
Article 6 For requests for instructions that require a reply, the party committee (party group) or organizational personnel department that accepts the report should study it carefully and respond to the reporter in a timely manner. The reporter should handle the matter according to the organization’s reply.
Article 7 The contents of the report shall generally be kept confidential. If the organization believes that it should be disclosed or the person requests it to be disclosed, it can adopt appropriate methods to disclose it within a certain range.
Article 8 If a leading cadre fails to report in accordance with these regulations or fails to truthfully report major personal matters, his or her organization shall, depending on the severity of the case, provide criticism and education, make corrections within a time limit, order an inspection, and notify criticism within a certain range, etc.
Article 9 Party committees, governments, disciplinary inspection and supervision agencies, and organizational and personnel departments at all levels must strengthen supervision and inspection of the implementation of these regulations. Organize human resources departments and disciplinary inspection and supervision agencies to make the implementation of these regulations by leading cadres a part of the assessment of cadres. The party committee (party group) and corresponding agencies responsible for accepting reports from leading cadres must comprehensively report the implementation of these regulations to the higher-level party committee and the Commission for Discipline Inspection once a year.
Article 10 All provinces, autonomous regions, municipalities directly under the Central Government, the Working Committee of Central Government Agencies and the Working Committee of Central State Agencies, and departments and units that implement system management may formulate specific measures based on these regulations and in light of actual conditions.
Article 11 These regulations are interpreted by the Central Commission for Discipline Inspection of the Communist Party of China and the Organization Department of the Central Committee of the Communist Party of China.
Article 12 These regulations shall come into effect on the date of promulgation. |
