In recent years, food safety, delivery timeliness and takeout service quality have increasingly become pain points and difficulties in platform management. On September 24, the State Administration for Market Regulation organized and drafted the "Basic Requirements for Food Delivery Platform Service Management" to solicit opinions. In response to chaos such as "ghost takeaways" and merchants "exploding orders", it proposed system requirements in terms of merchant entry and information review, and strictly adhered to the bottom line of food safety.
A few days ago, Professor Zhang Xin of our college was interviewed by CCTV-13 "Chao Wen Tian Xia". The so-called "ghost takeout" refers to the phenomenon of catering service providers who do not have "Business License", "Food Business License" and other qualifications and licenses, and provide illegal catering services on the takeout platform through illegal and illegal means such as fake certificates, certificate tampering, and borrowing certificates. Such merchants use false licenses and address information to operate online in violation of regulations, posing food safety risks. Zhang Xin said that in order to eradicate the chronic problem of "ghost takeout", the draft requires merchants to provide real licenses, store scene information and even "one shot to the end" positioning videos, and the platform will perform merchant access and dynamic review, supplemented by social supervision of "online proof". This "trinity" verification mechanism uses the authenticity of information as the starting point to block the entry channels of illegal merchants from the source.

The "explosion of orders" phenomenon refers to the instant overload of merchant service capabilities during the peak order period, which directly affects consumers' service experience. In order to resolve the risk of "exploding orders", the draft for comments introduces an "order control prompt" mechanism. Zhang Xin said that the platform can use algorithms to monitor merchants’ order loads and proactively warn when backlog trends occur. At the same time, the platform is encouraged to synchronously remind consumers, such as "the merchant is busy", while respecting the business autonomy of merchants, it effectively protects consumers' right to know, and thus collaboratively ensures the stability of takeaway catering services.
The protection of riders' rights and interests has attracted much attention, and problems such as overtime fines, excessive "standby" times, and insufficient protection have become increasingly prominent. The consultation draft clarifies the platform's social security obligations for different types of riders, and strengthens the protection of the rights and interests of food delivery riders through multiple measures such as standardizing the distribution of labor remuneration, reasonably regulating working hours, and providing career development care. Zhang Xin said that if the consultation draft clearly meets the conditions for determining labor relations, the platform should sign a labor contract with the delivery person. The platform should gradually increase the proportion of delivery personnel who directly sign labor contracts. For delivery personnel who do not meet the conditions of labor relations and register and receive orders through the platform, the platform should pay occupational injury insurance fees or purchase similar insurance, so that every order and every person must be insured. At the same time, the platform is required to standardize employment relations in terms of labor remuneration, social security, working hours, career development, etc. for delivery personnel to ensure reasonable income and rest rights for delivery personnel.
