This lecture was delivered by Dr. Chen Lin, deputy director of the Adjudication Office (Research Office) of the Dongcheng District People's Court of Beijing, and chaired by Lu Pei, associate professor of the Law w88 casino. Associate Professors Kong Xiangwen and Chen Xiaotong of the Law w88 casino were also present. Teacher Chen and the w88 law students gathered in Ningyuan Conference Room 724. She combined a wealth of practical cases and theoretical thinking to give the teachers and students an in-depth interpretation of the judge's right to interpret.

At the beginning of the lecture, Teacher Chen interacted with teachers and students through three legal issues. The first question revolves around the famous saying of US Justice Holmes that "the life of law lies not in logic, but in experience", leading to thinking about the nature of legal practice. The second question focuses on "how the judge handles when the parties' statements are inconsistent." The third issue regarding the interpretation of contract validity is the most controversial: when the two parties argue about breach of contract and the judge initially rules that the contract is invalid, whether the opinion should be disclosed. On-site students discussed judicial documents, and the interaction extended from warm-up to theoretical discussion, inspiring students to think about the procedural justice of interpretation rights.

Next, Teacher Chen explained in depth why explanations are needed in judicial trials, citing vivid practices and typical cases in which the People's Court has thoroughly implemented the spirit of General Secretary Xi Jinping's important instructions. Subsequently, she systematically explained the theoretical framework of the judge’s interpretation power from the three dimensions of institutional origin, core elements and value functions. By comparing concepts such as "authority inquiry", "litigation risk notification" and "post-judgment interpretation", she emphasized that the essence of the right to interpretation is "the pursuit of substantive justice on the basis of procedural fairness." Regarding the focus of controversy in practice, Teacher Chen deeply discussed the applicable boundaries and restraint mechanisms of the right of interpretation. She cited real cases in Germany and China as examples to illustrate the procedural flaws that may result from improper explanations. She called for the establishment of unified interpretation standards and relief mechanisms to avoid judicial disputes caused by "over-interpretation" or "insufficient interpretation."

Then, Teacher Chen looked forward to the development direction of the right of interpretation system based on the revision dynamics of the Civil Procedure Law and judicial reform trends. She proposed that in the future, a four-in-one interpretation power system of "purpose-scope-procedure-relief" should be constructed. Regarding the differences between administrative litigation and civil litigation, she emphasized that the use of interpretation power in administrative trials needs to pay more attention to the balance between judicial power and administrative power.

At the end of the lecture, Teacher Chen said that the essence of the right of interpretation lies in good communication. Lawyers must not only be proficient in legal provisions, but also learn to speak clearly about "legal principles" with righteous words, explain "reasons" clearly and empathize with others, so that the parties can understand the victory or defeat and be convinced.

This lecture opens up a multi-dimensional perspective for teachers and students to understand the judge’s interpretation power through the in-depth integration of theory and practice. Moderator Lu Pei concluded: "Teacher Chen's sharing is not only a feast of knowledge, but also a philosophical reflection on the nature of justice - judicial adjudication is never a 'cold collection of legal provisions', but a 'warm justice' achieved through communication and consensus."
