Regulations on Disciplinary Punishments of the Communist Party of China
Part 1 General Provisions
Chapter 1 Guiding Ideology, Principles and Scope of Application
Article 1 The Disciplinary Punishment Regulations of the Communist Party of China are guided by Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory and the important thought of "Three Represents", and are formulated in accordance with the Party Constitution, the Constitution and the law, and in conjunction with the practice of party building.
Article 2 The tasks of these Regulations are to safeguard the Party's charter and other intra-Party regulations, strictly enforce Party discipline, purify the Party's organization, protect the democratic rights of Party members, educate Party members to abide by the law, safeguard the unity and unity of the Party, and ensure the implementation of the Party's line, principles, policies, resolutions and national laws and regulations.
Article 3: Adhere to the principle that the party must manage the party and govern the party strictly. Party organizations at all levels and all Party members must abide by and maintain Party discipline. Party organizations and party members who violate party discipline must be dealt with seriously.
Article 4: Uphold the principle that all party members are equal before party discipline. No party organizations or members who are not subject to discipline are allowed within the party. All violations of party discipline must be investigated; those who should be punished by party discipline must be given corresponding sanctions.
Article 5: Adhere to the principle of seeking truth from facts. Violations of party discipline by party organizations and party members should be based on facts and based on the party constitution, other intra-party regulations and national laws and regulations, accurately determine the nature of the violation, differentiate between different situations, and handle them appropriately.
Article 6: Adhere to the principle of democratic centralism. The implementation of party disciplinary sanctions shall be decided upon collective discussion by the party organization in accordance with prescribed procedures, and no decision or approval by any individual or minority is allowed. Lower-level party organizations must implement decisions made by higher-level party organizations on party organizations and party members who violate party disciplines.
Article 7: Adhere to the principle of learning from past mistakes and avoiding future ones, and treating illnesses and saving lives. When dealing with party organizations and party members who violate party disciplines, punishment should be combined with education to achieve a balance between leniency and severity.
Article 8: These regulations apply to party organizations and party members who violate party discipline and should be held accountable by party discipline.
Chapter 2 Violation of Discipline and Disciplinary Punishment
Article 9 Party discipline is the rules of conduct that party organizations at all levels and all party members must abide by. Party organizations and party members who violate the Party Constitution and other intra-party regulations, violate national laws and regulations, violate party and national policies, socialist ethics, and endanger the interests of the party, the country, and the people must be held accountable if party disciplinary sanctions are imposed in accordance with regulations.
Article 10 Types of disciplinary sanctions against party members:
(1) Warning;
(2) Severe warning;
(3) Revocation of party positions;
(4) Stay with the party for probation;
(5) Expelled from the party.
Article 11 Disciplinary measures for party organizations that seriously violate party discipline:
(1) Reorganization;
(2) Dissolution.
Article 12: Party members who receive a warning or a serious warning shall not be promoted within the party within one year or recommended to non-party organizations for non-party positions higher than their original positions.
Article 13 The punishment of removal of intra-party positions refers to the removal of various positions within the party that were elected or appointed by the party members by the party member being punished. For those who hold more than two positions within the party, the party organization should make clear whether to remove all their positions or a certain position when making a disciplinary decision. If it is decided to revoke one of his positions, it must be revoked in order starting from the highest position he holds. For those who hold positions in non-party organizations, the non-party organizations should be advised to handle them accordingly in accordance with regulations.
For those who should be punished by removal of party positions but do not hold party positions, they should be given a serious warning. Among them, those who hold positions in non-party organizations should recommend that the non-party organization revoke their non-party positions.
A party member who is revoked from his or her position within the party shall not be allowed to hold a position within the party or recommend to an organization outside the party for a position that is equivalent to or higher than his or her original position within two years.
Article 14: The punishment of Party probation is divided into Party probation for one year and Party probation for two years. For party members who have been subject to probation for one year, if they still do not meet the conditions for restoration of party member rights after the expiration of the period, the period of probation for one year will be extended. The maximum period of party probation shall not exceed two years.
During the period of party probation and punishment, party members do not have the right to vote, elect or stand for election. During the period of party probation, if someone truly shows repentance, his or her rights as a party member will be restored after the expiration of the term; if someone persists in not correcting or is found to have other disciplinary violations that are subject to party discipline, he or she shall be expelled from the party.
A party member who is subject to party probation will have his or her party position automatically revoked. For those who hold non-Party positions, non-Party organizations should be recommended to revoke their non-Party positions. Party members who are subject to Party probation shall not hold positions within the Party or be recommended to non-Party organizations for positions that are equivalent to or higher than their original positions within two years after their rights as Party members are restored.
Article 15: Party members who are expelled from the Party shall not be allowed to rejoin the Party within five years. If there are other regulations that prohibit re-joining the party, the regulations shall apply.
Article 16: The leading bodies of party organizations that seriously violate party discipline and cannot be corrected themselves must be reorganized. Members of the leading body of the party organization who are subject to reorganization will be naturally removed from their posts, except those who should be punished by removal of their internal party positions or above (including removal of their internal party posts).
Article 17: A party organization in which all or a majority of its members seriously violate party discipline shall be disbanded. Party members in party organizations subject to dissolution should be examined one by one. Among them, those who meet the conditions for party membership should re-register and join a new organization to live the party life; those who do not meet the conditions for party membership will be declared expelled; those who violate disciplines will be investigated in accordance with regulations.
Chapter 3 Rules for the Application of Disciplinary Punishments
Article 18: Anyone who is punished for intentional violation of discipline and then subject to party discipline for intentional violation of discipline shall be severely punished.
Article 19: Miler or heavier punishment refers to giving lighter or heavier punishment within the range of punishment for disciplinary violations stipulated in the sub-provisions of these regulations.
Article 20 Reduced or aggravated punishment refers to the punishment imposed by one level of reduction or aggravation in addition to the punishment range for disciplinary violations stipulated in the sub-provisions of these regulations.
The regulations stipulate that only disciplinary violations of one level are expulsion from the party, and the rules on mitigating sanctions in the preceding paragraph do not apply.
Article 21 If one of the following circumstances occurs, a lighter or reduced punishment may be imposed in accordance with regulations:
(1) Taking the initiative to explain the issues for which one should be punished by party discipline;
(2) Taking the initiative to report issues that accomplices or other persons should be punished by party discipline, and it is verified to be true;
(3) Taking the initiative to recover losses or effectively preventing harmful consequences from occurring;
(4) Voluntarily withdrawing from illegal gains obtained in violation of disciplines;
(5) Those who have performed other meritorious services;
(6) As otherwise provided for in the sub-provisions of these regulations. Article 22 Depending on the special circumstances of the case, Party members who violate discipline may also be given reduced punishment beyond the disciplinary range stipulated in these Regulations, as determined by the Central Commission for Discipline Inspection or by the provincial (ministerial) level Commission for Discipline Inspection (excluding deputy provincial-level municipal Commission for Discipline Inspection) and submitted to the Central Commission for Discipline Inspection for approval.
Article 23: A party member who violates party discipline should be given a warning or a serious warning. However, if one of the circumstances stipulated in Article 21 of these regulations or there are other provisions in the sub-provisions of these regulations, he may be given criticism and education or organizational punishment and be exempted from party disciplinary sanctions. Party members who violate discipline shall be exempted from punishment and a written conclusion shall be made.
Article 24 If one of the following circumstances occurs, he may be given a heavier or heavier punishment in accordance with regulations:
(1) Forcing or instigating others to violate disciplines and laws;
(2) Conspiracy to confess or forge, destroy or conceal evidence;
(3) Preventing others from reporting and providing evidence;
(4) Shielding co-defendants or retaliating against critics, reporters, accusers, witnesses and other personnel;
(5) Any other behavior that interferes with or hinders organizational review;
(6) As otherwise provided for in the sub-provisions of these regulations.
Article 25: If a person commits two or more (including two) disciplinary violations that are subject to Party discipline sanctions as stipulated in the sub-provisions of these regulations, they shall be dealt with together, and the punishment shall be aggravated by the highest penalty among the several violations; if one of the disciplinary violations should be punished by expulsion from the Party, the punishment shall be expulsion from the Party.
Article 26: Based on an intentional or negligent violation of discipline, the behavior violates two or more (inclusive) clauses in the sub-provisions of these regulations, and shall be dealt with qualitatively in accordance with the clause with more severe punishment.
The constituent elements of a disciplinary violation stipulated in one clause are all included in the constituent elements of a disciplinary violation stipulated in another clause. If the special provisions are inconsistent with the general provisions, the special provisions shall apply.
Article 27: If two or more people (including two persons) jointly and intentionally violate disciplines, the leader shall be severely punished, unless otherwise provided in the sub-provisions of these regulations; other members shall be given party disciplinary sanctions according to their roles and responsibilities in the joint violation of disciplines.
For those who jointly violate disciplines in economic matters, they will be punished separately according to the amount of personal income and their role. The leading member of a group that violates disciplines shall be punished according to the total amount of the group's violations; for other leaders who jointly violate disciplines, if the circumstances are serious, they shall be punished according to the total amount of the group's joint violations.
Whoever instigates others to violate disciplines and laws shall be held accountable for Party discipline responsibilities based on their role in joint violations of disciplines.
Article 28: When the leading body of a party organization collectively makes a decision that violates Party discipline or commits other acts that violate Party discipline, members with common intention shall be treated as a joint violation of discipline; members who violate discipline at fault shall be punished separately according to their respective roles and responsibilities in collective violation of discipline.
Article 29: Disciplinary violations that are not stipulated in these regulations but endanger the interests of the party, the country and the people and require party discipline accountability shall be handled in accordance with the most similar provisions in the separate regulations. Cases that need to be handled comparatively, in accordance with the regulations on the authority to approve the punishment of party members, should be approved by the provincial (ministerial) level party committee and the Commission for Discipline Inspection, and submitted to the Central Commission for Discipline Inspection for approval; cases that should be handled by the party committee and discipline inspection commission below the provincial (ministerial) level, should be approved by the provincial (ministerial) level Commission for Discipline Inspection (excluding deputy provincial-level municipal Commission for Discipline Inspection) and reported to the Central Commission for Discipline Inspection for record.
Chapter 4 Disciplinary Punishment for Party Members who Illegal and Criminal Laws
Article 30: Anyone who falls under any of the following circumstances shall be expelled from the Party:
(1) Those who are sentenced to the main punishment (including suspended sentence) stipulated in the "Criminal Law of the People's Republic of China" in accordance with the law for intentional crimes;
(2) Deprivation of political rights solely or additionally;
(3) Being sentenced to fixed-term imprisonment of more than three years (excluding three years) due to negligence in accordance with the law.
Those who are sentenced to fixed-term imprisonment of less than three years (including three years) or sentenced to public surveillance or criminal detention due to negligent crimes shall generally be expelled from the party. For individuals who do not need to be expelled from the party, they must refer to the regulations on approval authority for disciplining party members and submit to the next higher-level party organization for approval.
Article 31: Anyone who is sent to reeducation through labor in accordance with the law shall be expelled from the Party, unless otherwise stipulated by the Central Committee of the Communist Party of China and the Central Commission for Discipline Inspection.
Article 32: If a party member is subject to party discipline and needs to be given administrative or other disciplinary sanctions, the party organization that made or approved the decision shall make suggestions to the relevant agencies or organizations; if a party member is suspected of committing a crime, he shall be transferred to the judicial authority.
Article 33: If a party member is subject to criminal prosecution in accordance with the law, the party organization shall, based on the effective judgments, rulings and decisions of the judicial organs and the facts, nature and circumstances determined, impose party disciplinary sanctions or organizational punishment in accordance with the provisions of these regulations.
If a party member is subject to administrative punishment or administrative punishment in accordance with the law and should be held accountable for party discipline, the party organization may, based on the facts, nature and circumstances determined by the effective administrative punishment or administrative punishment decision, impose party disciplinary sanctions or organizational punishment in accordance with the provisions of these regulations after verification.
If a party member violates national laws, regulations, the rules and regulations of enterprises, institutions, or other social organizations and is subject to other disciplinary sanctions and should be held accountable for party discipline, the party organization shall, after verifying the facts, nature, and circumstances determined by relevant parties, impose party disciplinary sanctions or organizational punishment in accordance with the provisions of these regulations.
Chapter 5 Other Provisions
Article 34: Party and state workers as mentioned in these regulations include party workers and state workers.
Party workers refer to the staff of the party’s organs at all levels other than workers and service personnel and party members in the party’s grassroots organizations who are engaged in party affairs full-time or part-time.
The identification of state workers and persons classified as state workers shall be carried out in accordance with the law and the legal interpretations and judicial interpretations of the Standing Committee of the National People's Congress.
Non-state workers as mentioned in these regulations refer to personnel in enterprises (companies) or other units other than state workers and personnel classified as state workers.
Article 35: If a probationary party member violates party discipline, and the circumstances are relatively minor, but the probationary party member qualification can still be retained, the probationary party member shall be criticized and educated or the probationary period shall be extended; if the violation is serious, the probationary party member qualification shall be revoked.
Article 36 Party members whose whereabouts are unknown after violating discipline shall be dealt with according to the circumstances:
(1) For those who commit serious disciplinary violations and should be expelled from the party, the party organization shall make a decision to expel them from the party;
(2) Except for the circumstances specified in the preceding paragraph, if a person's whereabouts are unknown for more than six months, the party organization shall remove him or her from the party in accordance with the provisions of the party constitution.
Article 37: If a party member who violates discipline dies before the party organization makes a decision on disciplinary action, or if it is discovered after his death that he has committed serious disciplinary violations, if he should be expelled from the party, he will be expelled from the party; if he should be given a sanction of Party probation or less (including Party probation), a written conclusion will be made, and no more party disciplinary sanctions will be imposed.
Article 38: Distinguishing persons responsible for dereliction of duty and dereliction of duty:
(1) Those directly responsible refer to party members or leading party cadres who fail to perform or incorrectly perform their duties within the scope of their duties and play a decisive role in the losses or consequences caused.
(2) Persons with main leadership responsibilities refer to party member leading cadres who, within the scope of their duties, fail to perform or incorrectly perform duties for the work they are directly in charge of, and are directly responsible for the losses or consequences caused.
(3) Persons with important leadership responsibilities refer to party member leading cadres who, within the scope of their duties, fail to perform or incorrectly perform their duties in the work they are responsible for or participate in the decision-making, and who bear secondary leadership responsibility for the losses or consequences caused.
Article 39: The term “voluntary confession” as mentioned in these Regulations means that party members suspected of violating disciplines explain their problems to the relevant organizations before the organization’s preliminary review, or they explain issues that the organization has not grasped during the initial review and investigation of their problems.
During the initial review and investigation of the case, if a party member suspected of violating discipline can cooperate with the investigation and truthfully confess the facts about his or her major disciplinary violations that the organization has learned, he may be given a lighter punishment.
Article 40 Direct economic losses refer to the actual value of property damage caused by a direct causal relationship with disciplinary violations. Calculating economic losses mainly calculates direct economic losses.
Article 41: The economic benefits obtained from disciplinary violations shall be confiscated or ordered to be refunded.
For positions, professional titles, academic qualifications, degrees, awards, qualifications and other other benefits obtained from disciplinary violations, the disciplinary inspection agency handling the case or its superior disciplinary inspection agency shall recommend that relevant organizations, departments, and units be corrected in accordance with regulations.
For party members who are dealt with in accordance with the provisions of Articles 36 and 37 of these Regulations, if after investigation it is confirmed that they have obtained benefits from committing disciplinary violations, they shall be dealt with in accordance with the provisions of this article.
Article 42: After a decision on party discipline is made, it shall be announced to all party members in the grassroots organization of the party where the party member is punished and himself within one month, and the materials on the decision shall be included in the party subject to punishment in accordance with the cadre management authority and organizational relationship. Those who are subject to sanctions above or above (including the removal of intra-Party positions) must also go through the corresponding change procedures for positions, wages, etc. within one month; if their non-party positions are revoked or adjusted, non-party organizations should be recommended to promptly cancel or adjust their non-party positions. Under special circumstances, the processing period may be appropriately extended with the approval of the organization that made or approved the disciplinary decision.
Article 43: The agency that implements the decision on party discipline or the unit where the party member is punished shall report the implementation status of the decision to the agency that made or approved the decision within six months.
If the Party discipline decision and other relevant handling procedures are not implemented in accordance with regulations, the main responsible persons and other directly responsible persons shall be held accountable. If the circumstances are serious and should be subject to party discipline sanctions, they shall be dealt with in accordance with the provisions of these regulations.
Article 44: The general principles of these Regulations shall apply to other intra-Party regulations that have provisions for Party disciplinary sanctions, except where there are special provisions in other intra-Party regulations promulgated or approved by the Central Committee of the Communist Party of China.
Part 2 Rules
Chapter 6 Violations of Political Disciplines
Article 45: Anyone who organizes or participates in rallies, marches, demonstrations and other activities that oppose the party's basic theory, basic line, basic program, basic experience or major principles and policies, the planners, organizers and key members will be expelled from the party.
For other participants or those who support the above-mentioned activities by providing information, materials, property, venues, etc., if the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be revoked from their positions within the party or placed on probation; if the circumstances are serious, they will be expelled from the party.
For those who are coerced into participating without knowing the truth, and who truly show repentance after being criticized and educated, they may be exempted from punishment or not punished.
Article 46: Anyone who adheres to the position of bourgeois liberalization and publicly publishes articles, speeches, declarations, statements, etc. that opposes the Four Cardinal Principles, or opposes reform and opening up, shall be expelled from the Party.
Anyone who publicly publishes articles, speeches, declarations, statements, etc. that violates the Four Basic Principles, violates reform and opening up, or has other serious political issues, shall be criticized and educated; if the circumstances are serious, a warning or a serious warning shall be given; if the circumstances are serious, he shall be dismissed from party positions, placed on party probation, or expelled from the party.
Whoever violates the relevant provisions of the Party and the state by broadcasting, publishing, or publishing the articles, speeches, declarations, statements, etc. listed in paragraphs 1 and 2, the principal responsible persons and other directly responsible persons shall be given a serious warning or the sanction of removal from their positions within the party; if the circumstances are serious, they shall be placed on party probation or expelled from the party.
Article 47: Anyone who brings reactionary books, periodicals, audio-visual products, electronic reading materials, etc. from outside the country (territory) shall be given criticism and education; if the circumstances are serious, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions, probation in the Party, or expulsion from the Party shall be given.
Article 48: Anyone who organizes or leads an illegal organization that aims to oppose the leadership of the party, oppose the socialist system, be hostile to the government, or endanger national security shall be punished by expulsion from the party for the planners, organizers and key elements.
For other participants, if the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be revoked from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the party.
Article 49: Anyone who organizes or leads a Taoist sect or cult organization shall have the planners, organizers and key members expelled from the Party.
For other participants, if the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be dismissed from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the party.
For participants who do not know the truth and show repentance after criticism and education, they may be exempted from punishment or not punished.
Article 50: Anyone who refuses to implement the party and the country’s principles, policies, and major work arrangements and decisions, or deliberately makes decisions that are contrary to the party and the country’s principles, policies, and major work arrangements and decisions, shall be given a serious warning or the person directly responsible shall be punished by being revoked from his or her position within the party; if the circumstances are serious, he shall be given probation or expelled from the party.
Article 51: Anyone who conducts activities to split the party by organizing secret groups within the party shall be punished by expulsion from the party.
Those who participate in secret groups or other activities that split the party will be subject to party probation or expulsion from the party.
Article 52: Anyone who participates in foreign (foreign) intelligence organizations or illegally provides intelligence to foreign (foreign) institutions, organizations, or personnel shall be expelled from the party.
Article 53: Anyone who surrenders to the enemy and rebels shall be punished with expulsion from the party. Those who surrender to the enemy will be expelled from the party.
Article 54: Anyone who applies for political asylum outside the country (territory) or a foreign embassy (consulate) in China, or who flees to a country (territory) or a foreign embassy (consulate) in China after violating disciplines and laws shall be expelled from the Party.
Anyone who publicly expresses remarks against the party or the government outside the country (territory) shall be handled in accordance with the provisions of the preceding paragraph.
Those who intentionally provide convenient conditions for the above-mentioned acts shall be subject to party probation or expulsion from the party.
Article 55: Anyone who instigates ethnic relations and creates trouble or participates in ethnic separatist activities shall be punished by expulsion from the party for the planners, organizers and key elements.
For other participants, if the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be revoked from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the party.
For those who are coerced into participating without knowing the truth, and who truly show repentance after being criticized and educated, they may be exempted from punishment or not punished.
If there are other acts that violate the ethnic policies of the Party and the country, and the circumstances are relatively minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the Party will be given.
Article 56: Anyone who organizes or uses religious activities to oppose the party's line, principles, and policies, incite riots, and undermine national unity and ethnic unity, the planners, organizers, and key members will be expelled from the party.
For other participants, if the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be revoked from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the party.
For those who are coerced into participating without knowing the truth, and who truly show repentance after being criticized and educated, they may be exempted from punishment or not punished.
If there are other violations of the party and the country's religious policies, if the circumstances are minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the party will be given.
Article 57: Those who organize and use clan forces to fight against the Party and the government, hinder the implementation of the Party and the country's principles and policies, laws and regulations, or create clan conflicts and undermine social stability, the planners, organizers and key members, if the circumstances are serious, shall be expelled from the Party or placed on probation; if the circumstances are minor, and they can acknowledge themselves and show repentance, they shall be dismissed from their party positions or given a serious warning.
Article 58: Those who fabricate rumors to smear the image of the party and the country shall be given a warning or a serious warning if the circumstances are minor; if the circumstances are serious, they shall be dismissed from party positions or placed on probation; if the circumstances are serious, they shall be expelled from the party.
If rumors are spread to vilify the image of the party and the country, and the circumstances are serious, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from the party's position will be given.
Article 59: In foreign-related activities, if his behavior has a negative impact on politics and damages the dignity and interests of the party and the country, he shall be punished by removal from party positions or probation; if the circumstances are serious, he shall be expelled from the party.
Chapter 7 Violations of organizational and personnel disciplines
Article 60: Anyone who violates the provisions of the Party Constitution and other intra-Party laws and regulations, uses fraud or other means to develop people who do not meet the requirements for party membership to become party members, or issues party membership certificates to non-party members, the person who is mainly responsible shall be given a warning or a serious warning; if the circumstances are serious, the penalty of removal from the party's position shall be given.
In case of violation of relevant regulations and procedures for recruiting party members, those who are mainly responsible shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 61: Anyone who violates the principle of democratic centralism, refuses to implement or changes major decisions made by the party organization without authorization, or violates the rules of procedure by allowing an individual or a small number of people to decide on major matters shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal from party positions or probation.
Article 62: If a lower-level party organization refuses to implement the decision of the higher-level party organization, the person who is mainly responsible shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal from the party's position or probation.
Article 63: Anyone who engages in non-organized activities within the party and undermines the unity and unity of the party shall be given a serious warning or the punishment of removal from the party's position; if the circumstances are serious, the punishment shall be probation or expulsion from the party.
Article 64: In the process of cadre selection and appointment, if the regulations on cadre selection and appointment are violated, the main responsible persons and other directly responsible personnel shall be held accountable. If the circumstances are relatively minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
During the election, if any activities are carried out that violate the Party Constitution, other intra-party regulations, national laws, regulations and other relevant charters, the main responsible persons and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
If the employer’s oversight and mistakes cause serious consequences, the main responsible person and other directly responsible personnel shall be dealt with in accordance with the provisions of the first paragraph.
Article 65: Anyone who refuses to implement the organization’s decisions on distribution, transfer, and communication shall be given a warning, a serious warning, or dismissed from his or her position within the party.
Article 66: In the recruitment, assessment, job promotion, professional title evaluation of cadres and employees, recruitment, placement of demobilized servicemen, etc., whoever conceals or distorts the facts or uses the convenience of his position to violate regulations to seek benefits for himself or others shall be given a warning or a serious warning; if the circumstances are serious, he shall be given a sanction of removal from the party position or probation.
Article 67: Anyone who violates relevant regulations by leaking test questions, cheating in the examination room, or altering examination papers during examinations and admissions shall be given a warning or a serious warning; if the circumstances are serious, the punishment of removal from party positions or probation shall be given; if the circumstances are serious, the punishment shall be expulsion from the Party.
Article 68: Anyone who improperly seeks to use public funds to go abroad (border) for himself or others, and the circumstances are relatively minor, shall be given a warning; if the circumstances are serious, a serious warning shall be given; if the circumstances are serious, a sanction of removal from the party's position shall be given.
Article 69: If a party member of a group (group) or personnel who temporarily goes abroad (outside the country) extends the period of stay abroad (outside the country) without authorization, or changes the route without authorization, causing adverse effects or economic losses, the person who is mainly responsible shall be given a warning or a serious warning; if the circumstances are serious, the punishment of removal from the party's position shall be given.
Article 70: If a party member in a foreign institution or a temporary overseas (overseas) group (group) leaves the organization without authorization, or a party member engaged in foreign affairs, confidential, military, etc. work violates relevant regulations and contacts and interacts with foreign (overseas) institutions or personnel, he or she shall be given a warning, a serious warning, or the punishment of removal from the party's position.
Article 71: Party members who are stationed abroad or in temporary overseas (overseas) delegations (groups) who leave the organization for less than six months and then return voluntarily shall be given a serious warning, revoked from their positions within the party, or remain on probation; if they leave the organization for more than six months, they will be treated as voluntarily quitting the party, and they will be removed from the party.
Those who deliberately provide convenient conditions for others to leave the organization and leave the organization shall be given a warning, a serious warning or the punishment of removal from the party's position; if the circumstances are minor and the party admits to self-examination, the punishment may be exempted.
Chapter 8 Violations of Integrity and Self-Discipline Provisions
Article 72 Taking advantage of one’s position to illegally possess state, collective, or personal property that is not under one’s control, or illegally possessing state, collective, or personal property by making symbolic payments when purchasing items, etc. If the circumstances are relatively minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the Party will be given.
If you take advantage of your position to pay or reimburse expenses that should be paid by you or your relatives by yourself or your relatives by your subordinate units or other units, they shall be handled in accordance with the provisions of the preceding paragraph.
If you take advantage of your position to pay or reimburse the expenses of studying abroad (overseas) for your spouse, children and their spouses that should be paid by individuals, it shall be handled in accordance with the provisions of the first paragraph.
Article 73: Anyone who takes advantage of his position to occupy public property for personal use for more than six months, and the circumstances are serious, shall be given a warning or a serious warning; if the circumstances are serious, he shall be given the sanction of removal from his position within the Party.
Anyone who occupies public property for profit-making or illegal activities shall be given a warning or a serious warning; if the circumstances are serious, he shall be dismissed from his party position or placed on probation; if the circumstances are serious, he shall be expelled from the Party.
Article 74: Party and state functionaries or other personnel engaged in official duties who accept gifts that may affect the fair execution of official duties and fail to register and hand them over to the public shall be given a warning or a serious warning if the circumstances are minor; if the circumstances are serious, they shall be dismissed from their party positions or placed on probation; if the circumstances are serious, they shall be expelled from the Party.
The personnel listed in the previous paragraph accept other gifts and should register for public release according to regulations but fail to register for public release. If the circumstances are relatively minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be dismissed from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the Party.
If you accept gifts during domestic official activities or foreign exchanges, but fail to do so when they should be handed over to the public according to regulations, they shall be dealt with in accordance with the provisions of Article 83 of these Regulations.
Article 75: If party and state functionaries or other personnel engaged in official duties take advantage of their positions to seek benefits for others, and their parents, spouses, children, their spouses, and other family members living together accept property from the other party, the person shall be held accountable. If the circumstances are serious, he or she shall be given a warning or a serious warning; if the circumstances are serious, he or she shall be dismissed from his or her position within the party or placed on probation.
If a person listed in the preceding paragraph takes advantage of his or her position to seek benefits for others and designates another third party to receive property from him or her, he or she shall be severely or aggravated in accordance with the provisions of the preceding paragraph.
If there is a situation specified in paragraph 1 and it is verified that I know it, it will be handled in accordance with the provisions of Article 85 of these Regulations.
Article 76: Spouses, children and their spouses of leading party members and cadres violate relevant regulations by engaging in business activities that may affect their fair performance of official duties in areas or business scopes under the jurisdiction of such party members and leading cadres, or foreign businessmen in areas or within the business scope under the jurisdiction of such party member leading cadres. If a party member and leading cadre holds a senior position appointed or appointed by a foreign party in a wholly-owned enterprise or a Sino-foreign joint venture, the party member leading cadre shall be corrected in accordance with regulations; if he refuses to be corrected, he or she shall resign from his current position or have his position adjusted by the organization; if he does not resign from his current position or refuses to obey the organization's adjustment of his position, he shall be punished by being revoked from his position within the party.
Article 77: Anyone who engages in profit-making activities in violation of relevant regulations and commits one of the following acts, if the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given:
(1) Business and enterprise;
(2) Individuals violate regulations by buying and selling stocks or making other securities investments;
(3) Engaging in paid intermediary activities;
(4) Registering a company or investing in shares abroad;
(5) Any other violation of relevant regulations to engage in profit-making activities.
Anyone who takes advantage of his position to seek benefits for the business activities of his relatives or friends shall be handled in accordance with the provisions of the preceding paragraph.
Anyone who violates relevant regulations by working part-time or working part-time for remuneration shall be dealt with in accordance with the provisions of paragraph 1.
Article 78: Anyone who squanders public property and commits any of the following acts, if the circumstances are minor, shall be given a warning or a serious warning; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given:
(1) Traveling with public funds or traveling abroad with public funds in the name of inspection, study, training, seminars, investment promotion, exhibitions, etc.;
(2) Violating regulations by participating in high-consumption entertainment and fitness activities paid for with public funds;
(3) Purchasing or replacing a car that exceeds the prescribed standards or luxuriously decorating the car you are riding in;
(4) Other acts of squandering public property.
Article 79: Whoever infringes on the interests of the state or the collective in the allocation or purchase of housing, and the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal of party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the Party.
Anyone who takes advantage of his position to use public funds to purchase a house for personal ownership shall be handled in accordance with the provisions of Article 83 of these Regulations.
Article 80: If the circumstances are serious when accepting banquets that may affect the fair execution of official duties, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given.
Article 81: Anyone who takes advantage of his position to arrange weddings and funerals and causes adverse effects on society shall be given a warning or a serious warning; if the circumstances are serious, he shall be given a sanction of removal from his position within the Party.
Those who take the opportunity to amass money or commit other acts that infringe upon the interests of the state, the collective and the people while organizing weddings and funerals shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.
Article 82: If there are other violations of the provisions on integrity and self-discipline, if the circumstances are minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
Chapter 9 Corruption and Bribery
Article 83: Party and state functionaries or persons entrusted with the management and operation of state-owned property take advantage of their positions to embezzle, steal, defraud or illegally possess public property by other means. If the circumstances are minor, they shall be given a warning or a serious warning; if the circumstances are serious, they shall be dismissed from their party positions or placed on probation; if the circumstances are serious, they shall be expelled from the Party.
Whoever embezzles party dues, social security funds, and funds and materials for disaster relief, emergency rescue, flood prevention, special care, poverty alleviation, immigration, relief, and epidemic prevention shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.
Article 84: If party and state organs, state-owned enterprises (companies), public institutions, and people's organizations violate relevant regulations by collectively and privately distributing state-owned assets to individuals in the name of the unit, the main responsible persons and other directly responsible persons shall be held accountable. If the circumstances are relatively minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
If discipline enforcement agencies, administrative law enforcement agencies, and judicial agencies violate relevant regulations by collectively and privately distributing property confiscated to the state that should be turned over to the state in the name of the unit, the principal responsible person and other directly responsible personnel shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 85: Party and state functionaries or other personnel engaged in official duties who take advantage of their positions to solicit other people's property, or illegally accept other people's property to seek benefits for others, shall be given a warning or a serious warning if the circumstances are relatively minor; if the circumstances are serious, they shall be dismissed from their positions within the party or placed on probation; if the circumstances are serious, they shall be expelled from the party.
The personnel listed in the previous paragraph take advantage of their positions to illegally accept property from others to seek benefits for others. If the circumstances are serious, they will be given a warning or a serious warning; if the circumstances are serious, they will be dismissed from their party positions, placed on party probation, or expelled from the party.
Those who cause serious losses to the interests of the country, the collective and the people by accepting bribes shall be severely punished or aggravated, up to and including expulsion from the party.
Whoever makes things difficult to retaliate against the other party due to attempted extortion of property and causes losses to the other party shall be given a warning or a serious warning; if the circumstances are serious, the punishment of removal from party positions or probation shall be given; if the circumstances are serious, the punishment shall be expulsion from the party.
Article 86: Party and state functionaries or other personnel engaged in public affairs who violate relevant regulations in their economic transactions by accepting property or kickbacks or fees in various forms, which are owned by themselves, shall be considered as accepting bribes and shall be dealt with in accordance with the provisions of Article 85 of these Regulations.
Article 87 If a party or state functionary or other person engaged in public service takes advantage of his/her position, or through the behavior of other party or state functionaries in his/her position, to seek illegitimate benefits for the client, to demand the client's property, or to accept or illegally accept the client's property in a disguised manner, he shall be dealt with in accordance with the provisions of Article 85 of these Regulations.
Article 88: After retiring (retiring), party and state functionaries take advantage of the convenient conditions created by their original powers or status to seek benefits for the client through the behavior of the serving party and state functionaries in their duties, and they personally solicit or illegally accept, or illegally accept in disguised forms, the property of the client, they shall be dealt with in accordance with the provisions of Article 85 of these Regulations.
Article 89: Where party and state organs, state-owned enterprises (companies), public institutions, and people's organizations solicit or illegally accept or illegally accept property from others to seek benefits for others, the main responsible persons and other directly responsible personnel shall be held accountable. If the circumstances are serious, they shall be given a warning, a serious warning, or revoked from their position within the party; if the circumstances are serious, they shall be given probation or expelled from the party.
Any unit listed in the preceding paragraph that secretly accepts rebates and handling fees in various names outside the accounts during economic transactions shall be considered as accepting bribes, and the principal responsible persons and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
If he retaliates against subordinate units or customers due to attempted expropriation of property and causes losses to the other party, the person primarily responsible and other directly responsible persons shall be given a warning or a serious warning; if a large loss is caused, the penalty of removal from the party position or probation shall be given; if a major loss is caused, the penalty of expulsion from the party shall be given.
Anyone who shares property solicited or illegally received, or illegally received in disguise, into a partnership shall be regarded as accepting bribes, and shall be dealt with in accordance with the provisions of Article 85 of these Regulations based on the amount of personal income and role played.
Article 90: In order to seek illegitimate benefits, give property and property to party and state functionaries or other personnel engaged in official duties. If the circumstances are relatively minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the party shall be given.
Anyone who violates relevant regulations in economic transactions and gives rebates or handling fees in property or various names to party and state functionaries or other personnel engaged in official duties shall be dealt with in accordance with the provisions of the preceding paragraph.
Those who cause serious losses to the interests of the country, the collective and the people due to bribery shall be severely or aggravated in accordance with the provisions of this article, up to and including expulsion from the party.
Article 91: In order to seek illegitimate interests, give property to party and state organs, state-owned enterprises (companies), public institutions, and people's organizations, or violate relevant regulations in economic transactions and provide kickbacks and handling fees in various names. If the circumstances are relatively minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the party will be given.
If a unit commits any of the acts listed in the preceding paragraph, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 92 Introducing bribes to party and state functionaries or other persons engaged in public affairs, if the circumstances are relatively minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the party will be given.
Article 93 If an unit pays bribes to seek illegitimate interests, or violates relevant regulations by giving property or kickbacks or fees in various forms to party and state functionaries or other personnel engaged in official duties, the main responsible persons and other directly responsible personnel shall be held accountable. If the circumstances are serious, they shall be given a warning, a serious warning, or revoked from their position within the party; if the circumstances are serious, they shall be given probation or expelled from the party. If the illegal gains obtained from bribery belong to individuals, they shall be handled in accordance with the provisions of Article 90 of these Regulations.
Article 94 If party and state functionaries or those entrusted with the management and operation of state-owned property take advantage of their positions to misappropriate public funds for personal use, conduct illegal activities, or engage in profit-making activities, or fail to repay them for more than three months, if the circumstances are relatively minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be given the sanction of removal from party positions or probation; if the circumstances are serious, they will be expelled from the party.
Whoever misappropriates party dues, social security funds, disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief, and epidemic prevention funds and materials shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.
If the misappropriation of public funds for personal use lasts less than three months, but the amount is relatively large, it shall be dealt with in accordance with the provisions of this article.
Article 95 Party members of rural party organizations, community party organizations, villagers committees, community residents' committees and other grassroots organizations engage in the following official duties, take advantage of their positions to illegally occupy public property, misappropriate public funds, demand other people's property, or illegally accept or disguised illegal acceptance of other people's property to seek benefits for others, shall be dealt with in accordance with the provisions of Articles 83, 94, and 85 of these regulations respectively:
(1) Management of party dues, social security funds, and funds and materials for disaster relief, emergency rescue, flood prevention, special care, poverty alleviation, immigration, relief, and epidemic prevention;
(2) Management of funds and materials donated to public welfare undertakings;
(3) Operation and management of state-owned land;
(4) Management of compensation fees for land acquisition;
(5) Collection and payment of taxes;
(6) Related to family planning, household registration, and military recruitment;
(7) Assist the people’s government in other administrative work;
(8) Engage in the party’s discipline inspection, organization (personnel), publicity and other work in accordance with intra-party regulations.
Article 96 If the property or expenditure of party and state functionaries or other personnel engaged in official duties obviously exceeds their legal income, and the difference is large, they may be ordered to explain the source. If they cannot explain that the source is legal, the difference shall be treated as illegal income, and they shall be given a serious warning or be revoked from their positions within the party; if the circumstances are serious, they may be given probation or expelled from the party.
Any party or state functionary who violates relevant regulations and conceals overseas deposits shall be dealt with in accordance with the provisions of the preceding paragraph.
Chapter 10 Behaviors that undermine the socialist economic order
Article 97: Those who engage in smuggling and the circumstances are minor shall be given a warning or a serious warning; if the circumstances are serious, they shall be dismissed from their party positions or placed on probation; if the circumstances are serious, they shall be expelled from the Party. Anyone who takes advantage of his position to conduct smuggling shall be severely punished.
If an unit smuggles, the person primarily responsible and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 98 If a non-state employee in an enterprise (company) or other unit takes advantage of his or her position to illegally take possession of the property of the unit as his or her own, if the circumstances are relatively minor, he or she shall be given a warning or a serious warning; if the circumstances are serious, he or she shall be dismissed from his or her position within the Party or placed on probation; if the circumstances are serious, he or she shall be expelled from the Party.
Article 99 If a non-state employee in an enterprise (company) or other unit takes advantage of his or her position to misappropriate the unit's funds for personal use or lends money to others, and fails to repay it for more than three months, or engages in profit-making activities, or engages in illegal activities, if the circumstances are relatively minor, he or she shall be given a warning or a serious warning; if the circumstances are serious, he shall be given the sanction of removal from party positions or probation; if the circumstances are serious, he shall be given the sanction of expulsion from the party.
Anyone who misappropriates the funds of the unit and does not return them shall be severely or aggravated in accordance with the provisions of the preceding paragraph.
If the funds of the unit are misappropriated for personal use for less than three months, but the amount is relatively large, it shall be dealt with in accordance with the provisions of this article.
Article 100: If state agencies, groups and institutions with funds allocated by the state misappropriate fiscal funds or special funds for scientific research, education, health, military industry, etc., the main responsible persons and other directly responsible personnel shall be held accountable. If the circumstances are relatively minor, they shall be given a warning or a serious warning; if the circumstances are serious, they shall be dismissed from their party positions or placed on probation; if the circumstances are serious, they shall be expelled from the Party.
Whoever misappropriates party dues, social security funds, disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration, relief, and epidemic prevention funds and materials shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.
Article 101: Non-state personnel in enterprises (companies) or other units who take advantage of their positions to extort property from others, or illegally accept or illegally accept property from others to seek benefits for others, if the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, they shall be given the sanction of removal from party positions or probation; if the circumstances are serious, the sanction shall be expulsion from the Party.
If any of the persons listed in the preceding paragraph violates relevant provisions in economic transactions and accepts kickbacks and handling fees in various names, which are owned by individuals, they shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 102: In order to seek illegitimate benefits, non-state personnel in enterprises (companies) are given property. If the circumstances are relatively minor, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from party positions or probation will be given; if the circumstances are serious, a sanction of expulsion from the Party will be given.
If a unit commits any of the acts listed in the preceding paragraph, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 103: Managers of state-owned enterprises (companies) who take advantage of their positions to operate themselves or for others to operate businesses similar to those of the enterprise (company) they work for, and seek illegal benefits, shall be given a warning or a serious warning; if the circumstances are serious, they shall be given the sanction of removal from their party positions or probation; if the circumstances are serious, they shall be expelled from the party.
If a person listed in the preceding paragraph registers an enterprise (company) in the name of another person, but in fact operates it himself, it shall be handled in accordance with the provisions of the preceding paragraph.
Article 104: Party members in state-owned enterprises (companies), public institutions and collectively owned enterprises (companies) who take advantage of their positions to commit any of the following acts and harm the interests of the country, the collective and the people shall be given a warning or a serious warning; if the circumstances are serious, they shall be given the sanction of removal from their party positions or probation; if the circumstances are serious, they shall be expelled from the party:
(1) Handing over the profit-making business of the unit to relatives and friends;
(2) Purchasing goods from units operated and managed by relatives and friends at prices significantly higher than the market price or selling goods to units operated and managed by relatives and friends at prices significantly lower than the market price;
(3) Purchasing substandard goods from units operated and managed by relatives and friends.
Article 105: If party and state organs violate relevant regulations when operating businesses, the main responsible persons and other directly responsible persons shall be given warnings or serious warnings; if the circumstances are serious, the punishment of removal from internal party positions shall be given.
Article 106: If financial practitioners violate financial laws and regulations, and the circumstances are minor, they will be given a warning or a serious warning; if the circumstances are serious, they will be dismissed from their party positions or placed on probation; if the circumstances are serious, they will be expelled from the Party.
If a financial enterprise or a national financial regulatory agency is forced to violate disciplines and laws, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
If financial practitioners violate financial laws and regulations due to illegal interference by party and state organs, financial practitioners may be given lighter or mitigated punishments in accordance with the provisions of paragraph 1. Among them, financial practitioners who resist will not be punished.
Article 107: If the circumstances are relatively minor and the statutory tax obligations are not fulfilled, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
If an entity fails to fulfill its statutory tax obligations, the principal responsible persons and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 108: Anyone who falsely issues, forges, illegally sells, illegally purchases, manufactures without authorization, or sells forged or unauthorized special value-added tax invoices or other bills that can be used to cheat or deduct taxes shall be punished by removal from party positions or probation; if the circumstances are serious, he shall be expelled from the party.
If a unit commits any of the acts listed in the preceding paragraph, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 109: Those who illegally occupy, buy and sell, or illegally assign or transfer land use rights in other forms, and the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, they shall be punished with removal from party positions or placed on probation; if the circumstances are serious, the punishment shall be expulsion from the Party.
If a unit commits any of the acts listed in the preceding paragraph, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 110: If social intermediary organizations engaged in asset evaluation, capital verification (certificate), accounting, auditing, legal services, etc., issue false assessments, false credit certificates, false authentication and other documents, the main responsible persons and other directly responsible persons shall be held accountable. If the circumstances are minor, warnings or serious warnings shall be given; if the circumstances are serious, the punishment of removal from party positions or probation shall be given; if the circumstances are serious, the punishment shall be expulsion from the party.
Article 111: In market economic activities, if one of the following acts is committed, the main responsible persons and other directly responsible persons shall be held accountable. If the circumstances are minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given:
(1) Producing and selling counterfeit and shoddy goods;
(2) Knowing or illegally obtaining inside information and conducting securities or futures transactions;
(3) Fabricating and disseminating false facts to damage other people’s business reputation and product reputation or falsely promote goods and services;

Chapter 11 Violations of financial disciplines
Article 113: Whoever conceals, withholds, or withholds fiscal revenue that should be turned over to the state shall be given a serious warning to the person primarily responsible and other directly responsible persons; if the circumstances are serious, he shall be given the sanction of removal from party positions or probation; if the circumstances are serious, he shall be given the sanction of expulsion from the Party.

If the money defrauded by false reporting, false claims, etc. is used to share the money privately, the principal responsible person and other directly responsible personnel shall be severely or aggravated in accordance with the provisions of the preceding paragraph, up to and including expulsion from the Party.
Article 115: If national fiscal funds and funds are not allocated according to the budget or use plan, the main responsible person and other directly responsible personnel shall be given a warning or a serious warning; if the circumstances are serious, the punishment of removal from party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the party.
Where treasury funds or funds from special fiscal accounts are used without authorization, the principal responsible persons and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 116: If an individual borrows public funds and fails to repay them for more than six months, the owed public funds shall be recovered. However, exceptions are made for those who are unable to return the money due to financial difficulties.

Article 118: If party and state organs violate relevant regulations by accepting gifts during internal and external activities but failing to do so, the main responsible persons and other directly responsible persons shall be held accountable. Article 121: Whoever provides guarantees for others in violation of relevant regulations shall be held accountable for the main responsible persons and other directly responsible persons. If the circumstances are minor, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
Article 122: Anyone who violates state-owned assets management regulations and causes the loss of state-owned assets shall be given a warning or a serious warning to the person primarily responsible and other directly responsible persons; if the circumstances are serious, the punishment of removal from party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the party.

If the circumstances are relatively minor, they shall be given a warning or a serious warning; if the circumstances are serious, they shall be given the sanction of removal from party positions or probation; if the circumstances are serious, they shall be expelled from the Party.
Whoever forges or alters accounting vouchers or accounting books, or prepares false financial accounting reports, or conceals or deliberately destroys accounting vouchers, accounting books, or financial accounting reports that should be kept in accordance with the law, the principal responsible person and other directly responsible persons shall be severely or severely punished in accordance with the provisions of the preceding paragraph.

Article 127: Party and state functionaries or other personnel engaged in official duties who fail to perform or incorrectly perform their duties at work and cause major losses to the interests of the party, the country and the people, as well as public property, shall be given a warning or serious warning; if major losses are caused, they shall be given sanctions of removal from party positions, probation in the party, or expulsion from the party. If there are other provisions in these Regulations, the provisions shall prevail.
If the personnel listed in the previous paragraph abuse their power or neglect their duties at work, causing major losses to the interests of the party, the country, the people, and public property, they will be given a serious warning; if they cause major losses, they will be given a sanction of removal from their party positions, probation in the party, or expulsion from the party. Those who practice favoritism and malpractice at work shall be severely punished or aggravated. If there are other provisions in these Regulations, the provisions shall prevail.
Article 128: If the person in charge of a party organization violates relevant regulations or is irresponsible at work, and falls under any of the following circumstances, causing considerable losses to the interests of the party, the country, the people, and public property, those directly responsible shall be given a warning or a serious warning. If major losses are caused, those who are directly responsible shall be given sanctions of removal from party positions, probation, or expulsion from the party; those with major leadership responsibilities shall be given a serious warning, removal of party positions, or probation; those with important leadership responsibilities shall be given a warning, serious warning, or revoked from party positions:
(1) Failure to communicate and implement, fail to inspect and supervise the implementation of the party and the country’s principles and policies, or make wrong decisions that violate the party and the country’s principles and policies;
(2) Open opposition to the party’s basic theory, basic line, basic program, basic experience, or party and national policies and policies in this region, this department, this system, and this unit;
(3) Failure to stop or investigate serious violations of discipline and law that occur in this region, this department, this system and this unit;
(4) Other violations of relevant regulations or irresponsible behavior in the construction of the party's ideology, organization, work style and the construction of party style and clean government.
If one of the above circumstances causes huge losses or adverse effects, the relevant responsible persons shall be severely punished in accordance with the provisions of the preceding paragraph.

(2) Failure to take measures or ineffective measures to deal with the production and sale of counterfeit and shoddy goods and other products endangering public safety, personal health, life and property safety by the unit or its subordinate units after discovery, or the purchase of counterfeit and shoddy goods due to serious irresponsibility;
(3) Failure to take measures to deal with or ineffective measures after discovery of acts of damaging national natural resources by the unit or subordinate units;
(4) Failure to observe for a long time the violations of laws and regulations in finance, finance, industrial and commercial administration, customs, accounting, statistics, etc. by the unit or its subordinate units or failing to correct them after being discovered;

Article 131: Anyone who violates relevant regulations at work or is irresponsible and falls under any of the following circumstances, causing greater losses to the interests of the party, the country and the people, and public property, those directly responsible shall be given a serious warning or be dismissed from their positions within the party. If major losses are caused, those who are directly responsible shall be given the sanction of probation or expulsion from the Party; those who bear major leadership responsibilities shall be given a serious warning, revoked from their positions within the Party, or shall be suspended from the Party; those who bear important leadership responsibilities shall be given a warning, serious warning, or dismissed from their positions within the Party:
(1) Causing major mistakes in the decision-making, design, construction, and commissioning of capital construction projects;
(2) Serious accidents occur in social management and services such as culture, education, health, postal and telecommunications, environmental protection, social welfare, etc.;
(3) Failure to take necessary and possible measures in the face of disasters or accidents, delaying opportunities, and causing losses that could have been avoided or reduced to be avoided or reduced;
(4) Concealing, lying, delaying or omitting reports of emergencies, major accidents and other important situations;

(1) Indifference to rallies, parades and other activities that are opposed to the party’s basic line, causing the majority of party members and the masses in the unit to participate in rallies, parades and other activities;
(2) Failure to resolve existing problems, resulting in intensification of conflicts, causing riots, strikes, class strikes or other major incidents, seriously affecting production, work, teaching and normal social order;
(3) Failure to stop or investigate and deal with the occurrence of unhealthy trends that are expressly prohibited;
(4) Failure to take timely measures to deal with major incidents that occur.
If one of the above circumstances occurs, causing huge losses or adverse effects, the relevant responsible persons shall be severely punished in accordance with the provisions of the preceding paragraph.
Article 133: In terms of safety work, if one of the following circumstances occurs, causing relatively large losses, those directly responsible shall be given a serious warning or dismissed from their party positions. If major losses are caused, those who are directly responsible shall be given the sanction of Party probation or expulsion from the Party; those who bear major leadership responsibilities shall be given the sanction of removal from Party positions or Party probation; those who bear important leadership responsibilities shall be given a warning, a serious warning, or the sanction of dismissal from Party positions:
(1) Failure to implement laws and regulations on labor protection, production safety and fire protection, resulting in explosions, fires, traffic safety, construction quality safety, mine safety and other accidents;
(2) Failure to take effective preventive measures against possible problems when organizing mass activities, resulting in a liability accident;
(3) Personal injury or death accidents in schools, kindergartens or public places due to irresponsible work;
(4) Producing and selling fake and inferior drugs or harmful food, and causing accidents that endanger personal health.
If one of the above circumstances occurs, causing huge losses or adverse effects, the relevant responsible persons shall be severely punished in accordance with the provisions of the preceding paragraph.
Article 134: Anyone who violates relevant regulations or is irresponsible in discipline enforcement, administrative law enforcement and judicial work, and falls under any of the following circumstances, those directly responsible shall be given a warning or a serious warning. If the circumstances are serious, those who bear direct responsibility will be given the sanction of removal from party positions or probation; those who have major leadership responsibilities will be given a warning or a serious warning. If the circumstances are serious, those who are directly responsible will be expelled from the Party; those who have major leadership responsibilities will be revoked from their party positions or placed on probation:
(1) During the investigation and handling of disciplinary and illegal cases, concealing the case and failing to report it, or suppressing the case and failing to handle it;
(2) Failure to respond or handle other people’s applications for protection of legitimate rights and interests without justifiable reasons;
(3) Taking preservation measures illegally or failing to perform statutory enforcement duties;
(4) Not transferring cases that should be transferred to other agencies or organizations in accordance with regulations;
(5) Violation of relevant regulations or irresponsibility during case handling resulting in casualties or other incidents.
Whoever practices favoritism or bends the law in administrative adjudication or case investigation, prosecution, trial, or trial activities, or who extorts confessions by torture, or obtains evidence by force, or who fails to correct the case after it is verified that it is an unjust, false, or wrong case, those who are directly responsible shall be given a serious warning or be revoked from their party positions; those who have major leadership responsibilities shall be given a warning or a serious warning. (1) Arbitrary charging and apportionment in various ways;
(2) Confiscating or expropriating property from others without authorization;
(3) There are other circumstances that force others to perform illegal obligations.
Article 136: Taking advantage of their position to force party and state functionaries or other personnel engaged in official duties to exercise their powers in violation of relevant regulations, if the circumstances are relatively serious, they shall be given a serious warning or be revoked from their positions within the party; if the circumstances are serious, they shall be given probation or expulsion from the party.
Anyone who forces citizens, legal persons or other organizations to commit acts that violate legal provisions shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 137: If an employee defectes due to irresponsible work, he or she shall be given a warning or a serious warning; if the circumstances are serious, he shall be given a sanction of removal from his position within the party.
If the responsible person runs away due to irresponsible work, and the circumstances are serious, a warning or a serious warning will be given; if the circumstances are serious, a sanction of removal from the party's position will be given.

Article 144: Anyone who violates labor management laws and regulations and infringes on the rights of others, and the circumstances are relatively serious, shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal from party positions, probation in the party, or expulsion from the party.
Article 145: Concealing, destroying or illegally opening other people's mails and letters, infringing on others' freedom of communication, and the circumstances are relatively serious, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions, probation in the party, or expulsion from the party shall be given.

Article 161: Anyone who infringes on public or private property and commits any of the following acts, and the circumstances are minor, shall be given a warning or a serious warning; if the circumstances are serious, the sanction of removal from party positions or probation shall be given; if the circumstances are serious, the sanction shall be expulsion from the Party:
(1) Stealing public or private property;
(2) Fraudulent public or private property;
(3) Stealing public and private property;
(4) Destroying or looting public or private property;
(5) Any other infringement of public or private property.
Those who extort public or private property will be punished by expulsion from the Party; if the circumstances are relatively minor, they will be punished by probation.
Article 162: Anyone who gathers people to gamble for the purpose of profit or uses gambling as a business shall be expelled from the Party.
Whoever participates in gambling and is a repeat offender, or has a large gambling capital, or gambles during working hours, or gambles outside the country (outside of the country), shall be given a warning, a serious warning, or the punishment of being revoked from the party position; if the circumstances are serious, the punishment shall be probation or expulsion from the party. Party members and leading cadres who participate in gambling shall be severely punished or aggravated.
Intentionally providing venues or other convenient conditions for gambling activities, and if the circumstances are serious, a warning, a serious warning, or removal from the party's position will be given; if the circumstances are serious, a person will be placed on probation or expelled from the party.
Article 163: Anyone who obstructs party and state functionaries or other persons engaged in official duties from performing official duties in accordance with disciplines and law, if the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, a sanction of removal from party positions or probation shall be given; if the circumstances are serious, a sanction of expulsion from the Party shall be given.
Article 164: Anyone who disrupts and destroys public order such as production, transportation, work, etc. shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal of party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the Party.
Whoever engages in feudal superstitious activities and disrupts the order of production, work, and social life shall be severely punished or aggravated in accordance with the provisions of the preceding paragraph.
Article 165: Anyone who forges, alters, buys or sells, or uses forged official documents, certificates, or seals of party and state organs, enterprises (companies), public institutions, and people's organizations shall be given a serious warning; if the circumstances are serious, he shall be given the sanction of removal from party positions or probation; if the circumstances are serious, he shall be expelled from the party.
Whoever seizes official documents, certificates, and seals of party and state organs, enterprises (companies), public institutions, and people's organizations shall be severely or severely punished in accordance with the provisions of the preceding paragraph.
Anyone who forges, alters, trades or uses forged academic qualifications or diplomas shall be dealt with in accordance with the provisions of the first paragraph.
Article 166: Anyone who violates the laws and regulations on population and family planning and exceeds the family planning limit shall be given a serious warning or the punishment of removal from the party position; if the circumstances are serious, the punishment shall be probation or expulsion from the party.
Those who undermine the implementation of laws and regulations on population and family planning will be punished by removal from party positions or probation; if the circumstances are serious, they will be expelled from the party.
Article 167: Anyone who violates national laws and regulations on the protection of the environment, natural resources, cultural relics and historic sites, etc., and the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal of party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the Party.
If a unit commits any of the acts listed in the preceding paragraph, the principal responsible person and other directly responsible persons shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 168: Those who fabricate or spread false information or other information that is harmful to society, and the circumstances are relatively serious, shall be given a warning or a serious warning; if the circumstances are serious, they shall be dismissed from their party positions, placed on party probation, or expelled from the party.
Article 169: Anyone who violates relevant regulations, invades and destroys computer information systems, and harms the interests of the party, the country and the people, and the circumstances are relatively minor, shall be given a warning or a serious warning; if the circumstances are serious, the punishment shall be removal of party positions or probation; if the circumstances are serious, the punishment shall be expulsion from the party.
Article 170: Those who harbor criminals and the circumstances are relatively minor shall be given a serious warning or the punishment of removal from their party positions; if the circumstances are serious, the punishment shall be probation; if the circumstances are serious, the punishment shall be expulsion from the Party.
Those who harbor terrorist organizations, underworld organizations and their main members shall be expelled from the party.
Those who harbor serious disciplinary violations and should be subject to disciplinary sanctions shall be given a warning or a serious warning; if the circumstances are serious, they shall be given a sanction of removal from their party positions.
Article 171: Anyone who is deceived by criminals and provides convenient conditions for their criminal activities shall be given a warning or a serious warning; if the circumstances are serious, he shall be given a sanction of removal from party positions or probation.
Article 172: Party members stationed abroad or in temporary overseas (overseas) delegations (groups) who violate the laws and regulations of the country or region where they are stationed, or do not respect the religious customs of the country or region where they are stationed, and the circumstances are relatively serious, shall be given a warning or a serious warning; if the circumstances are serious, they shall be dismissed from their party positions, placed on party probation, or expelled from the party.
Article 173: Anyone who violates national (border) management laws and regulations and crosses the national (border) border secretly shall be expelled from the party.
Article 174: If there are other acts that impede social management order, and the circumstances are relatively serious, a warning or a serious warning shall be given; if the circumstances are serious, a sanction of removal from party positions, probation in the party, or expulsion from the party shall be given.
Part 3 Supplementary Provisions
Article 175: The Central Commission for Discipline Inspection of the Communist Party of China is responsible for the interpretation of these Regulations.
Article 176 The Central Military Commission may, in accordance with these Regulations and in conjunction with the actual conditions of the Chinese People's Liberation Army and the Chinese People's Armed Police Force, formulate supplementary regulations or individual regulations.
Article 177: The party committees of all provinces, autonomous regions, and municipalities directly under the Central Government, the Working Committee of the Central Government Organs, the Working Committee of the Central State Organs, the Party Committee of the State-owned Assets Supervision and Administration Commission of the State Council, the China Banking Regulatory Commission, the China Securities Regulatory Commission, the China Insurance Regulatory Commission, and other party committees (party groups) of other vertically managed departments may, in accordance with these Regulations and in combination with the actual conditions of their respective work, formulate individual implementation regulations and report them to the Central Commission for Discipline Inspection of the Communist Party of China for record.
Article 178 These Regulations shall come into effect on the date of promulgation.
If a case that has been closed before the promulgation of these Regulations needs to be reviewed and reconsidered, the regulations or policies at that time shall apply. For cases that have not yet been closed, if the regulations or policies at the time when the behavior occurred do not consider it to be a disciplinary violation, but these Regulations consider it to be a disciplinary violation, it will be handled in accordance with the regulations or policies at the time; if the regulations or policies at the time the behavior occurred are considered to be a disciplinary violation, it will be handled in accordance with the regulations or policies at the time. However, if this Regulation does not consider it to be a disciplinary violation or the punishment is lighter, it will be handled in accordance with the provisions of these Regulations.
