w88 casino News Network (provided by the Law w88 casino)On the afternoon of November 28, 2024, the 44th "International Business and Economics Law w88 casino Student Legal Salon" sponsored by the w88 casino Law w88 casino and the editorial department of "International w88 casino Law" was successfully held in Room 232, Ningyuan Building.

This salon continues the format of thematic discussions and focuses on the theme of "Legal Responses to the Commercial Use of Artificial Intelligence Technology in the Field of Online Car Hailing". This issue of the salon received a total of 40 papers submitted by students. The research content is rich, including data security, tort liability distribution, criminal liability and other multiple perspectives. In this salon, two students, Li Jiaqi and Wu Haoyu, gave keynote speeches, and invited Professor Feng Hui and doctoral student Hu Hongtao from the Law w88 casino to serve as commentators.

The event begins with the speakers delivering keynote speeches in sequence. Spokesperson Wu Haoyu believes that as artificial intelligence plays an increasingly important role in autonomous driving systems, its risks are becoming increasingly prominent. This is because the camera devices, sensing devices, voice recording devices, etc. installed on driverless online ride-hailing vehicles will continuously collect in-car data, including the behavior, language, representation, trajectory, preferences, etc. of each passenger. This information will be stored and processed in a centralized manner. If used improperly, it will lead to the risk of leakage and abuse, and then become a tool for privacy snooping. But at the same time, he believes that the collection and use of personal data is also the key to the current development of smart driving online ride-hailing. Blindly strong supervision is not conducive to the development of this emerging industry and the improvement of international competitiveness. Therefore, he suggested strengthening special compliance legislation for driverless online ride-hailing to make up for the shortcomings of current laws and regulations, formulating personal data storage and deletion policies based on data categories, improving systems and services for cross-border transmission of online ride-hailing personal data, and promoting the safe and efficient export of personal data, thereby balancing the dual goals of information protection and industry development, and assisting the "landing" of my country's autonomous driving commercialization.

Teacher Feng Hui commented on the article’s problem awareness and content orientation. The teacher first believes that the problem awareness of this article can be further refined. For example, it can be refined into a discussion of the scope of data collection for driverless online ride-hailing, or strategies for hierarchical classification of information collection in the field of driverless online ride-hailing, and can be discussed in detail and in depth. The teacher used "passenger physical condition" as an example and proposed that this type of information is personal sensitive information, but it is worth discussing whether the driverless online ride-hailing system can be allowed to collect this type of information based on emergency medical needs. The key to the problem of information collection is not "implementing hierarchical classification", but how to classify and how to classify, etc. Only in this way will it have more practical significance. Secondly, the teacher reminded everyone to pay attention to the fact that the use of information and data is closely related to the scenario, and sharing and control are two inseparable dimensions. Finally, the teacher led everyone to discuss which information collection can be exempted from the principle of notification and consent, and reminded everyone to strictly treat issues such as the minimum necessary principle of information collection and the scope of operators' safety protection obligations.

Li Jiaqi then spoke. From the perspective of data security, she analyzed the current status of personal information collection and use in the driverless online ride-hailing industry and the corresponding legal rules. She also deeply explored the shortcomings of the online ride-hailing industry in the collection, storage, use, and sharing of personal information. On this basis, she proposed relevant solutions, including improving the legal and regulatory system for personal information protection, building a regulatory mechanism for online ride-hailing data security, using technical means to ensure personal information security, and strengthening consumers' awareness of data security protection, hoping to achieve the protection of consumers' personal information and promote the healthy development of the online ride-hailing industry.

Teacher Feng Hui believes that the problem awareness of the article needs to be refined based on practical needs. First of all, the teacher emphasized the discussion of personal information collection issues and the need to pay attention to the balance between business model development and legal risk prevention and control. Secondly, combined with the questions and discussions of the students on the spot, the teacher reminded everyone that in traditional industries, events that are considered accidental in emerging industries and new business models often have a catastrophic impact on the entire industry and business model, and the law should play an overall anticipatory guidance role, rather than just make up for real problems after the fact. Finally, the teacher reminded everyone that in the process of business development, we should also pay attention to the issue of employment competition between artificial intelligence and workers, and how to treat and protect employment opportunities in the traditional taxi and online ride-hailing industries.

Ph.D. student Hu Hongtao recognized the ideas of the two papers and made suggestions on the structure of the two papers. He reminded everyone that in the process of searching for problem awareness, on the one hand, we must pay attention to the fact that personal information is a kind of right, not a right, and we must not ignore the basic theoretical issues involved. On the other hand, we must think about it in conjunction with practical needs.

Finally, the teacher and the students present also discussed the role of the government in this issue, the difference between the way of thinking in economic law and the way of thinking in personal information law, how to find problems in paper writing, how to demonstrate one's own opinions, etc. In summary, the holding of this salon gave students a deeper understanding of the legal issues surrounding the commercialization of artificial intelligence technology in the field of online ride-hailing. This salon ended successfully with the positive interaction of all participating students.
